母親に懲役８年＝「絶望、察するに余りある」－目黒女児虐待死・東京地裁

　東京都目黒区の船戸結愛ちゃん＝当時（５）＝が虐待死した事件で、必要な医療措置を受けさせなかったなどとして保護責任者遺棄致死罪に問われた母親の優里被告（２７）の裁判員裁判の判決が１７日、東京地裁であった。守下実裁判長は「（結愛ちゃんの）絶望感は察するに余りある」と述べ、懲役８年（求刑懲役１１年）を言い渡した。
　守下裁判長は結愛ちゃんについて、「大好きだった実母から意識が薄れても医療措置を受けさせてもらえなかった」と言及した。

　判決は、一家が目黒区に転居した２０１８年１月２３日以降、結愛ちゃんは先に上京していた父親の雄大被告（３４）＝同罪などで起訴＝から、「俺がいない間に太った」と苛烈な食事制限を受けたと指摘。死亡までの約１カ月で「体重の約２５％が失われた」と認定した。
　優里被告については、「児童相談所の関与を拒絶し、結愛ちゃんの生存維持は被告に委ねられていたのに、雄大被告の暴行を容認した」と非難。一方、雄大被告からの心理的ドメスティックバイオレンスの影響も考慮し、「雄大被告の意向に正面から反しない範囲で、結愛ちゃんの苦痛を和らげる努力はした。深く反省している」とした。（2019/09/17-17:55）

Tokyo District Court sentenced a 27-year-old mother to a prison term of eight years on Tuesday for failing to protect her child in a high-profile abuse case that led to the death in March 2018 of the five-year-old girl following violence by her stepfather.
   Public prosecutors demanded an 11-year prison term for Yuri Funato for failing to provide necessary medical care to the girl in a case of parental negligence resulting in death. The defense side claimed five years was appropriate.
   In court hearings of the trial by lay judges, the prosecutors claimed that the stepfather, Yudai, 34, started severely abusing the girl, Yua, after the family moved to Tokyo's Meguro Ward from Kagawa Prefecture, western Japan, on Jan. 23, 2018.
   The prosecutors said the girl was given little food and was assaulted by the stepfather and that she had bruises and other wounds on over 170 places on her body. They also said the girl lost about 4 kilograms in the some two months before she died.
   The mother tolerated the abuse by the stepfather as she prioritized him over the girl, the prosecutors said.
