法務省、「グルーミング」罪新設検討　子どもの性被害防止

　法務省は、子どもの性被害を未然に防ぐため、「グルーミング罪」を新設する検討に入った。グルーミングはわいせつ目的を隠して子どもに近づくもので、インターネット交流サイト（ＳＮＳ）の普及をきっかけとした性被害が社会問題化している。
　１０月２４日の法制審議会（法相の諮問機関）の刑事法部会で示された試案に盛り込まれた。同省は議論がまとまれば刑法改正案を国会に提出する方針だ。
　試案では、１６歳未満に対しわいせつ目的で面会を要求すれば１年以下の拘禁刑か５０万円以下の罰金を科す。実際に面会した場合はより重い２年以下の拘禁刑か１００万円以下の罰金とする。
　親切心から子どもと接しようとした人が処罰されないよう、(1)脅す、うそをつく、誘惑する(2)拒まれたのに要求を繰り返す(3)金銭を渡す、またはその約束をする―のいずれかの行為をした場合を対象とした。
　わいせつな画像を撮らせてＳＮＳなどで送信するよう要求した場合も、１年以下の拘禁刑か５０万円以下の罰金とする。いずれの場合も、被害者が１３～１５歳のケースでは、５歳以上の年齢差があることが適用条件となる。
　警察庁の統計によると、２０２１年にＳＮＳがきっかけとなって犯罪被害に遭った１８歳未満は、１８１２人（うち児童ポルノ関連は６５７人）だった。１７年以降、毎年約１８００～２０００人の高い水準で推移しており、性犯罪の被害者支援に取り組む団体からは「グルーミングし放題、児童に対して声を掛け放題という状況が起きている」として、新たな罰則を求める声が上がっている。（2022/11/01-07:06）

Japan's Justice Ministry is considering establishing a new crime of sexual grooming, or the practice of approaching children for the concealed purpose of sexually abusing them.
   The idea is being discussed as sex crimes against children are becoming a social problem in Japan amid the spreading use of social media.
   The envisaged new crime was included in a draft proposal presented Oct. 24 at a subcommittee meeting of the Legislative Council, which advises the justice minister.
   Once the discussions are completed, the ministry aims to submit a bill to revise the Penal Code to the Diet, the country's parliament.
   The draft calls for imposing a prison sentence of up to one year or a fine of up to 500,000 yen on those asking children aged under 16 to meet for the purpose of molestation. If the offenders actually meet the children, they would be subject to a prison sentence of up to two years or a fine of 1 million yen.
