諫早干拓、差し戻し＝開門めぐるねじれ解消せず－訴訟長期化へ・最高裁

　国営諫早湾干拓事業（長崎県）で、国が漁業者に潮受け堤防排水門の開門を強制しないよう求めた訴訟の上告審判決で、最高裁第２小法廷（菅野博之裁判長）は１３日、国側勝訴とした二審福岡高裁判決を破棄し、審理を同高裁に差し戻した。「開門を強制することが権利の乱用となるか、さらに審理を尽くさせる」と述べた。４裁判官全員一致の意見。

　事業をめぐる一連の訴訟では、国に「開門」と「非開門」の相反する義務を課した判決が確定している。最高裁判決で司法判断のねじれは解消されず、訴訟はさらに長期化することになった。（2019/09/13-19:46）

Top Court Reverses Verdict Favoring Govt over Isahaya Gates

The Supreme Court on Friday reversed a Fukuoka High Court ruling in 2018 that favored the government over the state-managed Isahaya Bay reclamation project in Nagasaki Prefecture, southwestern Japan, sending the case back to the high court.
The top court's Second Petty Bench issued the latest ruling in a lawsuit presided over by Justice Hiroyuki Kanno, following the same panel's decision in two other related lawsuits in June not to allow the floodgates built under the project to be opened.
In the lawsuit, the central government seeks to invalidate a ruling by the same high court in 2010 that ordered the state to open the gates of the Isahaya Bay dike.
