参院選「合憲」３件に＝３倍の「１票格差」－大阪高裁など

　「１票の格差」が最大３．００倍だった今夏参院選は違憲として、弁護士らが各地の高裁・高裁支部に選挙無効を求めた訴訟の判決で、大阪高裁と名古屋高裁金沢支部は２９日、いずれも「著しい不平等状態ではない」などと格差を「合憲」と判断、請求を棄却した。一連の訴訟で言い渡された判決は計５件で、「合憲」が３件、「違憲状態」が２件となった。
　大阪高裁の石井寛明裁判長は「格差を是正しながら、他の政策目的と調和する具体的な制度を見いだすことは容易でない」と指摘。名古屋高裁金沢支部の田中寿生裁判長も制度を改める難しさに理解を示し、「国会の是正の決意が失われたとは言えない」などと述べた。（2019/10/29-15:36）

A Japanese high court and a high court branch ruled Tuesday that the July 21 election for the House of Councillors was constitutional in terms of vote-value disparity.
   As a result, the number of verdicts that have found the election constitutional in the recent series of lawsuits rose to three.
   The day's rulings were handed down by Nagoya High Court's branch in Kanazawa, Ishikawa Prefecture, central Japan, and Osaka High Court in western Japan. They were the fourth and fifth verdicts in the 16 lawsuits filed with 14 high courts and high court branches by two groups of lawyers.
   The groups demand the annulment of the election for the upper chamber of the Diet, Japan's parliament, in which the maximum vote-value disparity was 3.00 times.
   Earlier this month, Takamatsu and Sapporo high courts concluded that the election was held in a state of unconstitutionality, saying that a full-fledged review of the current election system has to be taken. Both courts stopped short of invalidating the election results.
