斎藤知事「対応に瑕疵ない」　専門家は公益通報法違反指摘―自民など辞職申し入れへ・兵庫県議会

　兵庫県の斎藤元彦知事は６日の県議会調査特別委員会（百条委員会）で、自身のパワハラ疑惑の告発文書を作成、配布した職員（７月に死亡）を公益通報者保護法に基づく保護対象としなかったことについて「瑕疵（かし）はない」と証言した。専門家は県による法令違反を指摘したが、斎藤氏は「公益通報に該当するとは思っていない」と述べ、主張が食い違った。
　斎藤氏への証人尋問は先月３０日に次いで２回目。百条委での審議を踏まえ、各会派は斎藤氏への不信任決議案を含めた検討を本格化させる。立憲民主党などの県議による「ひょうご県民連合」は９月議会に不信任案を提出する方針。県民連合と最大会派の自民党県議団は１２日に斎藤氏に辞職を求める申し入れを行う。日本維新の会は来週にも方針を決める。
　職員は３月中旬、告発文書を報道機関などに配布。４月４日には同様の内容を県の公益通報窓口に通報した。しかし、県は職員を保護対象とせず、５月７日に停職３カ月の懲戒処分とした。
　斎藤氏に先立ち、参考人として出席した消費者庁公益通報者保護制度検討会委員を務める弁護士の山口利昭氏は、３月中旬に職員が文書を配布した時点で「公益通報者保護法上の外部通報に当たる」と述べた。
　また、公益通報者として保護する前に真実かどうかの調査を行うことは「普通はない」と指摘。告発が不正を目的としていない限り、県は職員が不利益な取り扱いを受けないための措置を講じる義務があり、「今も違法状態が続いている」と述べた。
　これに対し、斎藤氏は告発内容がうわさ話を集めていることなどを理由に「真実相当性がない」と主張。懲戒処分について職員が「公益通報の調査結果を待つべきだ」と進言したと証言したことには、「進言を受けた記憶はない」「手続きを取っ払って処分を早くしろとは言っていない」と述べた。百条委は今後、消費者庁に県の対応に違法性がないか見解を求める考え。
　一方、贈答品を巡り、斎藤氏はカキ、カニ、ワイン、日本酒やスポーツウエアなどを受け取ったことを認めたが、ゴルフセットの受け取りは否定した。職員へのパワハラ疑惑については「私としては業務上の範囲だった」と釈明した。（2024/09/06-20:56）

Hyogo Governor Motohiko Saito said Friday that the western Japan prefecture did not err in its decision not to protect as a whistleblower a prefectural government official who died after accusing him of harassment.
   In sworn testimony to a special investigative committee of the Hyogo prefectural assembly, Saito defended the decision against protecting the official under the whistleblower protection law, saying he believes that the allegations did not amount to whistleblowing. Meanwhile, an expert said that the decision violated law.
   It was Saito's second testimony before the powerful investigative committee, set up under Article 100 of the local autonomy law. His first appearance took place Aug. 30.
   Various groups in the assembly will consider in earnest their future moves, including possibly supporting a no-confidence motion against the governor, based on the committee's deliberations.
   A group including members of the Constitutional Democratic Party of Japan plans to submit such a motion this month, while a Liberal Democratic Party-affiliated group, the largest force in the assembly, will mull the matter as early as Friday night. Nippon Ishin no Kai (Japan Innovation Party) hopes to decide its course of action next week.
