旧統一教会の勝訴破棄　「訴訟起こさぬ」念書は無効―献金勧誘で初判断・最高裁

　世界平和統一家庭連合（旧統一教会）の信者だった女性（死亡）の長女が、献金を巡り違法な勧誘を受けたなどとして約６５００万円の損害賠償を求めた訴訟の上告審判決が１１日、最高裁第１小法廷であった。堺徹裁判長は返金を求める訴訟を起こさないとする女性作成の念書について「公序良俗に反し無効」と判断。教団側勝訴とした二審判決を破棄し、審理を東京高裁に差し戻した。
　裁判官５人全員一致の意見。最高裁が教団の献金勧誘行為について判断するのは初めてで、同様の訴訟などにも影響しそうだ。
　同小法廷は念書の有効性について「趣旨や目的、対象となる権利、当事者が被る不利益の程度などを総合考慮すべきだ」との判断枠組みを初めて示した。その上で、女性が作成時８６歳と高齢で、半年後には認知症と診断された点や、見返りもなく１億円超を献金したことなどを挙げ、「一方的に大きな不利益を与える」として、無効と結論付けた。
　宗教団体の献金勧誘行為についても違法性を判断する際の枠組みを初めて提示。献金が自由な意思で行われているか、本人や配偶者の生活に支障が生じていないかなどを総合的に考慮し、「社会通念上相当な範囲を逸脱すると認められる場合、違法と評価される」とした。
　女性は当時、加齢による判断能力低下の可能性が否定できず、自らの土地を売却して献金するなどしており、「献金の態様は異例」「生活の維持に無視し難い影響を及ぼす額だ」と指摘。新たに示した枠組みに基づいて違法性の有無を判断するため高裁に差し戻した。
　一、二審判決などによると、女性は２０１５年１１月、公証役場で念書を作成し、教団に提出した。１７年３月、長女と共に返金を求めて教団と勧誘した信者を提訴。一審判決後に死亡した。
　一審東京地裁は２１年５月、念書は女性の正常な判断能力に基づき作成されたと認め、請求を退けた。二審も２２年７月、一審判決を支持した。
　判決を受け、教団は「差し戻しという結果になったことは残念でならない」などとコメントした。（2024/07/11-18:06）

Japan's Supreme Court overturned Thursday a lower court ruling that was in favor of the Unification Church in a 65-million-yen damages lawsuit over donations solicited by the controversial religious group.
   The top court's First Petty Bench, presided by Justice Toru Sakai, sent the case back to Tokyo High Court. It was the Supreme Court's first ruling on donation solicitations by the group, whose formal name is the Family Federation for World Peace and Unification.
   In the lawsuit, filed by the first daughter of a deceased female believer, the top court found that a memorandum created by the plaintiff's mother stating no lawsuit would be filed to request the return of the donations "violated public order and morality, and was invalid."
   The decision is likely to affect other Unification Church donation cases involving similar documents, people familiar with the matter said.
   According to the rulings of district and high courts, the then church member created the memorandum at a notary office in November 2015 and submitted it to the church. But after being diagnosed with dementia a half year later, she sued the church and its followers involved in the donation solicitations with her daughter in March 2017 to get the money back.
