盗難仏像、対馬の寺に所有権　最高裁判決受け、返還へ―韓国

　【ソウル時事】長崎県対馬市の観音寺から盗まれた仏像を巡り、韓国中部・瑞山の浮石寺が所有権を主張し、保管する韓国政府に対し引き渡しを求めた訴訟で、韓国最高裁は２６日、浮石寺側の上告を棄却した。浮石寺の所有権を認めず、所有権は観音寺にあると認定した。韓国政府は今後、日本側への返還に向けた手続きを進める方針だ。
　仏像は、長崎県指定文化財の「観世音菩薩坐像」。韓国人窃盗団が２０１２年に対馬市の観音寺から盗み出し、韓国に持ち込んだ。浮石寺が１４世紀に日本人主体の海賊「倭寇」に持ち去られたものだとして所有権を主張し提訴。一審で勝訴、二審は敗訴していた。
　最高裁は判決で、１９７３年に民法の「取得時効」が成立し、観音寺が所有権を得たと指摘。浮石寺は「仏像の所有権を失った」と判断した。ただ、１４世紀に仏像を制作した浮石寺と原告の浮石寺が同じだと認める資料が不足しているとした二審判決は誤りだとし、同一であることは認めた。
　判決を受け、韓国外務省報道官は２６日の記者会見で「最高裁の判決を尊重する」と表明。「今後の返還手続きなどについては、関連法令に従い、関連機関で決定していく」と説明した。日韓関係の改善に尽力する尹錫悦政権としては、外交問題とならないよう早期に返還したい考えとみられる。
　一方、浮石寺側の関係者は判決後、記者団に「最高裁は不法な略奪を合法化した。野蛮な判決だ」と強調。「判決を認めることはできない」と憤った。
　日本政府や観音寺は仏像の返還を求めてきたが、浮石寺が所有権を主張したため、現在まで韓国政府が保管している。１２年に同じ窃盗団が対馬市の海神神社から盗んだ国指定重要文化財「銅造如来立像」は、所有権の主張がなく、１５年に日本側に返還されている。（2023/10/26-17:40）

South Korea's Supreme Court on Thursday ruled that a Buddhist statue stolen from a Japanese temple in 2012 belongs to the temple, dismissing an appeal for ownership filed by a South Korean temple.
   The ownership of the statue went to Kannonji Temple on the island of Tsushima in the southwestern Japan prefecture of Nagasaki by acquisitive prescription in 1973, the top court said, concluding that Buseok Temple in the South Korean city of Seosan lost the ownership.
   Buseok Temple filed the appeal after its claims of ownership was dismissed by Daejeon High Court in a reversal from a lower court ruling that recognized the South Korean temple's ownership.
   The Supreme Court, however, ruled that Buseok Temple is the same as the temple that created the statue in the 14th century, denying the high court's decision that there were not enough documents to prove that they are identical.
   The statue was stolen from Kannonji Temple and smuggled into South Korea by a South Korean group of thieves. The Japanese government has been asking for the return of the statue, which is a designated cultural property of Nagasaki.
