強制不妊、国に初の賠償命令　旧優生保護法は「違憲」―大阪高裁

　旧優生保護法によって不妊手術を強制されたとして、近畿地方在住の３人が国に計５５００万円の損害賠償を求めた訴訟の控訴審判決が２２日、大阪高裁であった。太田晃詳裁判長は、原告の訴えを退けた一審判決を取り消し、計２７５０万円の支払いを国に命じた。旧法の強制不妊の規定は違憲と判断した。
　強制不妊をめぐる訴訟のうち、高裁レベルでは初の判断。６件の一審判決はいずれも原告敗訴で、国の賠償責任を認めたのは初めて。今後の司法判断に影響を与える可能性があり、国の対応も焦点となる。
　訴えたのは、近畿地方の知的障害のある７０代女性と、いずれも聴覚障害のある大阪府の７０代女性、その夫の８０代男性。１９６０～７０年代に障害を理由に不妊手術を強いられ、子どもを持つ機会を奪われたと主張していた。
　不法行為から２０年で賠償請求権が消滅する「除斥期間」の適用可否が主な争点。太田裁判長は、国が障害者に対する差別や偏見を「固定化し、助長してきた」結果として、「訴訟提起の前提となる情報へのアクセスが著しく困難な環境にあった」と認定した。
　旧法の差別的な規定が廃止された９６年が起算点になるとしたが、「除斥適用をそのまま認めることは著しく正義・公平の理念に反する」と指摘。情報へのアクセスが困難な環境が解消されてから６カ月間は「除斥適用の制限が相当」とした。
　原告の女性については、「子をもうけて生命をつなぐという人としての根源的な願いを絶たれた」として、重大な人権侵害だと指摘。一方、国会議員が被害者への救済措置を講じてこなかった「立法不作為」は違法ではないと判断した。
　２０２０年１１月の一審大阪地裁判決は旧法を違憲と判断する一方で、「国が訴訟の提起ができない状況を積極的に作り出したとまでは認められない」と認定し、除斥期間を理由に訴えを退けていた。（2022/02/22-21:05）

Osaka High Court overturned a lower court ruling Tuesday, ordering the Japanese government to pay a total of 27.5 million yen in damages over forced sterilization under the now-defunct eugenic protection law.
   This is the first ruling by a Japanese high court over suits for state compensation over forced sterilization. It is also the first ruling that has recognized state responsibility for compensation over the matter. Plaintiffs had lost in all six suits filed with district courts.
   The Osaka court also found that the provisions of forced sterilization stipulated in the former law were unconstitutional.
   The suit was filed by three plaintiffs--a woman in her 70s with intellectual disability in the Kinki western region, a woman in her 70s and her husband in his 80s in Osaka Prefecture, western Japan, both with hearing impairments. They demanded that the government pay 55 million yen in damages in total.
   The woman in the Kinki region and the woman in Osaka claimed that they were deprived of the opportunity to have children as they were forced to undergo sterilization in 1965 and 1974, respectively.
