２５歳男に無期懲役　「他事件と比べ重いと言えず」―新潟女児殺害・地裁

　新潟市西区で昨年５月、小学２年の女児＝当時（７）＝を殺害したとして、殺人などの罪に問われた小林遼被告（２５）の裁判員裁判の判決が４日、新潟地裁であった。山崎威裁判長は、「弱者を狙った無差別な事件だが、同種の事件と比べ、特に重いとは言えない」と述べ、無期懲役（求刑死刑）を言い渡した。
　検察側は「まれにみる悪逆非道な犯行」とし、被害者１人でも死刑を回避すべき事情にならないと主張。弁護側は殺意を否定し、傷害致死罪にとどまると主張していた。
　山崎裁判長は、「女児が脱力するまで首を絞め続けており、客観的に死ぬ危険性が高い行為。被告もそれを認識していた」と殺意を認定した。
　その上で、死刑が適切かどうか検討。まれに見る凄惨（せいさん）な事件で遺族の思いは察するに余りあるとする一方、「死刑が究極の刑罰である以上、慎重さと公平性は特に求められる」と述べた。
　具体的には、無差別的犯行である一方、殺人の計画性は認められず、方法も際立って残虐とは言えないと指摘。殺害された被害者が１人の事件の量刑傾向を見ると、「わいせつ目的の殺人は原則として無期懲役刑を科すべきものといえる」と述べ、無期懲役とした。
　判決によると、小林被告は昨年５月７日、新潟市西区の路上で女児に車を衝突させて連れ去り、駐車場に止めた車の中でわいせつな行為をし、首を手で圧迫し殺害。その後、遺体を線路上に放置し、電車にひかせた。（2019/12/04-18:23）

A Japanese court sentenced Wednesday a 25-year-old man to an indefinite prison term for murdering a seven-year-old girl and abandoning her body on a railway track in the central prefecture of Niigata in May last year.
   "The case is an indiscriminate attack on a weak person, but it cannot be said that this is more serious than similar offenses," said Takeshi Yamazaki, presiding judge at Niigata District Court.
   During court hearings in a lay-judge trial, public prosecutors said that the man, Haruka Kobayashi, committed a cruel crime. The death penalty should not be avoided based on the fact that he killed only one person, the prosecutors said.
   The defense side denied that Kobayashi had an intention to kill the girl, claiming that he should be punished on charges of inflicting injury resulting in death.
   The judge said that as the man continued choking her until she showed muscle weakness, the act was highly likely to cause death. He was aware of this, the judge said, recognizing an intention to kill.
