「合憲」１４件、「違憲状態」２件　参院選１票格差、高裁判決出そろう

　１票の格差が最大３．００倍だった７月の参院選は違憲だとして、弁護士らが選挙無効を求めた訴訟の判決で、東京高裁（村上正敏裁判長）は４日、格差を「合憲」と判断、請求を棄却した。これで二つの弁護士グループが全国の高裁・高裁支部に起こした計１６件の訴訟の一審判決が出そろい、「合憲」が１４件、「違憲状態」が２件となった。来年にも最高裁が統一判断を示す見通し。
　一連の訴訟の焦点は、２０１６年参院選の最大格差３．０８倍から縮小させた埼玉選挙区の定数増をどう評価するか。「違憲状態」とした高松、札幌両高裁は「弥縫（びほう）策」「（選挙制度の）仕組み自体が見直されたとは評価できない」などと非難。一方、「合憲」とした１４件は「抜本的見直しとは言えないが、国会はさらなる是正を目指している」などと捉えた。（2019/12/04-15:33）

14 Rulings Find Japan July Upper House Election Constitutional

Tokyo High Court found Wednesday that the House of Councillors election in July was constitutional, marking the 14th such ruling on the triennial poll for the upper of parliament.
   The high court rejected a petition to invalidate the election results.
   The ruling was the last on a total of 16 lawsuits filed by two groups of lawyers with high courts and high court branches across the country to seek to annul the election results due to wide vote-value disparities.
   Two of the 16 rulings found that the election was held in a state of unconstitutionality.
   The Supreme Court is expected to issue a unified judgment as early as next year.
