衆院選無効求め一斉提訴　「１票の格差」違憲主張―弁護士ら

　２７日に投開票された衆院選は「１票の格差」が是正されておらず、投票価値が不平等で違憲だなどとして、二つの弁護士グループが２８日、選挙無効を求める訴訟を一斉に起こした。
　升永英俊弁護士らのグループは全ての小選挙区について、全国１４の高裁・支部に提訴。山口邦明弁護士に代わり、新たに代表となった三竿径彦弁護士らのグループも、広島県内の小選挙区について広島高裁に訴えを起こした。
　升永弁護士グループは提訴後、東京都内で記者会見した。伊藤真弁護士は「住んでいる場所に関わりなく国民の声が正しく届く選挙でなければならない」と指摘。「裁判所は違憲判決を出し、司法の役割を果たしてほしい」と訴えた。
　各地の選挙管理委員会によると、投開票日の有権者数が最も多いのは北海道３区の４６万６８９人で、最も少ない鳥取１区は２２万３７１３人。試算では１票の格差は２．０６倍で、２０２１年の前回衆院選の２．０８倍から縮小した。
　小選挙区の定数を「１０増１０減」して区割りを見直した改正公選法が２２年１２月に施行された。２０年国勢調査に基づけば最大格差は２倍未満だったが、その後に格差が拡大した。
　原告側は、憲法が求める投票価値の平等に違反しており、選挙は無効だと主張。升永弁護士らのグループは、選挙区割りを検討する審議会の設置法が１票の格差を２倍未満とするよう求めており、選挙は違法だったとも訴えている。（2024/10/28-18:03）

A Japanese group of lawyers led by Hidetoshi Masunaga filed lawsuits with Fukuoka High Court and elsewhere Monday morning to nullify the previous day's general election for the House of Representatives.
   The group seeks to invalidate the election results for all single-seat constituencies of the lower chamber of parliament, saying that the poll was unconstitutional because it was carried out without correcting vote-value disparities.
   Separately, some members of the group and a team of other lawyers including Kuniaki Yamaguchi are planning to file similar suits in the afternoon.
   "Elections provide the only venue where citizens can engage in the exercise of state power," lawyer Takanori Hirai told a press conference in Fukuoka, southwestern Japan, after the filing.
