マニュライフ生命に業務改善命令　「節税保険」初処分―金融庁

　金融庁は１４日、過度な節税が問題となっていた中小企業経営者向けの「節税保険」の不適切な販売をめぐり、マニュライフ生命保険に対し保険業法に基づく業務改善命令を出した。保険本来の趣旨から外れた節税を売り物にした商品開発や営業手法を問題視した。節税保険に関する行政処分は初めて。８月１５日までに経営責任の明確化を含め業務改善計画の提出を求めた。
　金融庁が問題視したのは、節税保険の契約者の名義を、解約時の返戻率が低い時期に、法人から個人に変更し、返戻率が高くなってから、税負担の軽い一時所得として返戻金を受け取れるようにする「名義変更プラン」。旧経営陣が商品設計を主導し、組織を挙げて販売していたとして、「とりわけ旧経営陣の責任は非常に重い」と指摘した。
　２０２１年の国税庁による通達改正で、これまでの名義変更プランが販売できなくなると、同社は年金保険を使った名義変更プランを考案。通達改正の抜け穴を突いた形で商品開発・募集が行われていたとして、「悪質性、故意性も認められる」と断じた。
　業務改善命令を受け、マニュライフ生命は「行政処分を厳粛に受け止める」とのコメントを発表した。（2022/07/14-20:01）

Japan's Financial Services Agency on Thursday issued a business improvement order to Manulife Life Insurance Co. over sales of "tax-saving insurance" plans for small business owners.
   It is the first time that the agency has taken administrative action over such insurance plans.
   The FSA took issue with the development by the subsidiary of Canada's Manulife Financial Corp. of products with an emphasis on their tax-saving effects, instead of the original intent of insurance.
   The agency demanded that the firm submit by August 15 a business improvement plan, including the clarification of management responsibility.
   The insurance products in question are designed to allow policyholders to receive refunds in a way that reduces tax payments.
