侮辱罪厳罰化、改正刑法が成立　「拘禁刑」を創設

　侮辱罪に懲役刑を導入し、法定刑の上限を引き上げる改正刑法が１３日の参院本会議で、自民、公明両党などの賛成多数で可決、成立した。深刻化するインターネット上の誹謗（ひぼう）中傷に歯止めをかけるのが狙いで、今夏にも施行する。
　侮辱罪をめぐっては、ネットで中傷を受けたプロレスラー木村花さん＝当時（２２）＝が命を絶った問題をきっかけに、厳罰化の機運が高まった。現在は拘留と科料しかない侮辱罪の法定刑に、１年以下の懲役と禁錮、３０万円以下の罰金を追加する。
　国会審議では、野党から厳罰化が言論弾圧につながるとの強い懸念が示された。このため、表現の自由に対する不当な制約になっていないか、３年後に検証する付則が追加された。
　現行の懲役刑と禁錮刑を一本化し、受刑者の特性に応じて刑務作業と指導を柔軟に組み合わせる「拘禁刑」の新設も盛り込んだ。刑の種類や名称の変更は、１９０７年の刑法制定以来初めて。再犯防止の観点から、指導・教育により力を入れる狙いで、法務省は３年後の施行を目指している。（2022/06/13-11:08）
