元会長に懲役８年　「顧客ないがしろ、強い非難」―ジャパンライフ詐欺・東京地裁

　磁気治療器の販売預託商法を展開したジャパンライフ（東京、破産手続き中）をめぐる巨額詐欺事件で、詐欺罪に問われた同社元会長山口隆祥被告（７９）の判決が２８日、東京地裁であり、浅香竜太裁判長は「顧客の大切な財産をないがしろにして会社の延命を図った。強い非難が妥当だ」として懲役８年（求刑懲役１０年）を言い渡した。
　浅香裁判長は、ジャパンライフが老後の生活への不安を巧みにつく営業活動を繰り返し、顧客と契約を結んでいたと指摘。被告は会社の経営が逼迫（ひっぱく）していたのに「自分の指示通り動く企業体質を利用し営業させていた」とし、「責任を一手に担うべきなのは当然だ」と述べた。
　その上で、消費者庁から巨額の負債隠蔽（いんぺい）などを顧客に通知するよう求められたのに耳を傾けず、返金を求める顧客には撤回を求めるよう社員に指示していたと認定。「被害額は相当高額で、大部分が返還されずにいる。老後の蓄えなどを失った被害者らの処罰感情が厳しいのは当然だ」と非難し、被告が罪を認めていることや、健康状態などを考慮しても長期の実刑は免れないと結論付けた。
　判決によると、山口被告は会社の資金繰り悪化で配当金の支払いや元本返済をできる見込みがないことを隠し、２０１７年８～１２月、顧客２０人から契約金として計約１億６５６０万円をだまし取った。（2022/01/28-17:41）

Tokyo District Court sentenced Takayoshi Yamaguchi, former chairman of failed multilevel marketing company Japan Life Co., to eight years in prison on Friday over a massive fraud case.
   Public prosecutors had sought a 10-year prison term for Yamaguchi, 79.
   The defense side asked for a lenient ruling for Yamaguchi, who admitted to the fraud charges.
   According to the indictment, Yamaguchi swindled a total of some 165.6 million yen from 20 clients between August and December 2017 by concluding contracts under which they bought magnetic health equipment for renting out for fees, while hiding the fact that his company was cash-strapped and had no prospect of making dividend payments or principal repayments.
   Over the fraud case, 12 other people, including a former Japan Life president and former executives of the company, were charged with violations of the investment law. Suspended guilty sentences handed down to all of them have been finalized.
