米軍厚木基地でのパワハラ認定　国に５５万円賠償命令―東京地裁

　米軍厚木基地（神奈川県）で勤務していた日本人女性が上司の米国人からパワハラを受けたなどとして、国に計約３９００万円の損害賠償を求めた訴訟の判決が２２日、東京地裁であった。三輪方大裁判長は訴えを一部認め、５５万円の支払いを命じた。
　女性の代理人弁護士によると、在日米軍基地で勤務する日本人へのパワハラと国の責任を認めた判決は初めてとみられる。
　判決によると、女性は同基地の後方支援部で米軍関係者らの支援事務作業に従事していた２０１３年１０～１２月、上司から「あなたはうそつきだ」「クビにしてやる」「やることすべて間違っている」などと叱責された。
　三輪裁判長は「上司という職場内の優位性を背景に人格権を侵害するものだ」とパワハラを認定。女性は１４年２月に適応障害と診断されたが、叱責との間に因果関係があるとした。
　その上で「米国がパワハラ防止義務を怠ったことは明らか」と判断。日本政府は米軍関係者へ労務提供するために女性を雇用する立場にあり、米国に義務違反がある場合は賠償責任を負うと結論付けた。
　一方で、女性が訴えていた退職とパワハラとの因果関係は否定した。女性の代理人を務める小川治彦弁護士は「在日米軍基地でのパワハラを認め、国に賠償を命じたのは意義がある。ただ、退職との因果関係が認められなかったのは遺憾で、控訴を検討する」と話している。
　防衛省は「一部、裁判所の理解が得られなかったと受け止めている。慎重に検討し、適切に対応する」とコメントした。（2021/11/22-16:24）

Tokyo District Court ordered the Japanese government Monday to pay 550,000 yen in damages to a Japanese woman over so-called power harassment at a U.S. base in Japan.
   According to the lawyer representing the woman, this is believed to be the first court decision that has recognized the power harassment of a Japanese national working at a U.S. military base in Japan and the responsibility of the Japanese government.
   Presiding Judge Masahiro Miwa partially upheld the claims by the woman, who sought 39 million yen in damages for the workplace harassment by her former boss, a U.S. national, at the U.S. military's Atsugi base in Kanagawa Prefecture, near Tokyo.
   According to the ruling, she was scolded by her then supervisor between October and December 2013, when she was engaged in clerical work supporting U.S. military personnel at the base's logistics support division at the base.
   The boss told her that she was a liar, threatened to fire her and blasted her acts, the ruling said.
