新井浩文被告に懲役５年　「卑劣で悪質」求刑通り―マッサージ店女性乱暴・東京地裁

　自宅で出張マッサージ店の女性従業員に乱暴したとして、強制性交罪に問われた元俳優新井浩文被告（４０）＝本名・朴慶培、韓国籍＝の判決が２日、東京地裁であった。滝岡俊文裁判長は「卑劣で悪質」と非難し、求刑通り懲役５年を言い渡した。無罪を主張していた被告は即日控訴した。
　滝岡裁判長は、女性の証言について、事件数日後に被害状況を記したメモなどと合致し「信用性は高い」と判断。「被告は何度も抵抗されたのに性交に及んだ。体格差もあり、暴行は女性の抵抗を著しく困難にさせるものだった」と認定し、弁護側の暴行していないとの主張を退けた。
　弁護側は「被告は合意があったと誤信した」とも主張したが、判決は、女性の店が性的サービスを禁止し、被告も同意書に署名していたことなどを挙げ、「誤信は到底考え難い」と否定。「施術中という抵抗しにくい状況に付け入り、厳しい非難に値する」と批判した。
　判決によると、新井被告は２０１８年７月１日未明、当時住んでいた東京都世田谷区のマンションで、女性に頭を押さえ付けるなどの暴行を加え、わいせつな行為をした。（2019/12/02-11:30）

Tokyo District Court on Monday sentenced former actor Hirofumi Arai, 40, to a prison term of five years for forcibly having sex with a female massage therapist at his home.
   The sentence, which came against Arai's claim of innocence, matched the punishment sought by public prosecutors. Arai, a South Korean national whose real name is Park Kyung-sik, immediately appealed the ruling to a higher court.
   According to the ruling, Arai sexually assaulted the woman at his then apartment in Tokyo's Setagaya Ward in the predawn hours on July 1, 2018, when he was receiving massage service from her.
   In handing down the ruling, Presiding Judge Toshifumi Takioka condemned the act by Arai as "despicable and vicious." The accused "dared to have sex with the woman although he faced repeated resistance from her," the judge said.
   During his trial, the defense insisted that Arai was falsely convinced at the time that she consented to have sex with him.
