今夏参院選「違憲状態」＝３．０倍の１票格差、初判決－無効とは認めず・高松高裁

　「１票の格差」が最大３．０倍だった今年７月の参院選は投票価値の平等に反し違憲だとして、弁護士らが選挙無効を求めた訴訟の判決が１６日、高松高裁であった。神山隆一裁判長は格差を「著しい不平等で違憲状態」と判断した。選挙を無効とは認めなかった。
　神山裁判長は、３．０倍の格差を「常識的に許容し難く、最大１．９８倍だった２０１７年１０月の衆院選に大きく劣後している」と指摘。国民の権利意識が強くなっていることも挙げ、「投票価値の著しい不平等状態」と認定した。
　さらに、最高裁大法廷が「合憲」とした１６年参院選の３．０８倍から縮小させた定数是正について、「弥縫（びほう）策にすぎず、今夏参院選までに抜本的な是正措置を取るという最高裁の合憲判断の前提が崩れている」と述べた。
　一方、是正が図られた経緯などを踏まえ、「国会が違憲状態を認識し得たとまで認めることは困難」と判断。選挙の無効請求は退けた。
　二つの弁護士グループが全国１４の高裁・高裁支部に起こした計１６件の訴訟で、最初の判決。各地の判決は年内に出そろう見通しで、上告されれば最高裁が統一判断を示す。（2019/10/16-16:10）

Takamatsu High Court ruled Wednesday that the July 21 election for the House of Councillors, the upper chamber of parliament, was held in a state of unconstitutionality in terms of vote-value disparities.
   But Presiding Judge Ryuichi Kamiyama dismissed the plaintiffs' demand to annul the election.
   The ruling at the high court in Kagawa Prefecture, western Japan, was the first on a total of 16 lawsuits filed by two groups of lawyers calling for invalidating the Upper House election, which had vote-value disparities of up to 3.0 times.
   Rulings on the remaining cases are expected to be issued by the end of this year across the country. The Supreme Court is likely to hand down a unified ruling if appeals are filed against the high court decisions.
   In the July election, the number of voters per seat was the highest in Miyagi Prefecture, northeastern Japan, and the lowest in the central prefecture of Fukui, following a revision to the public offices election law.
