父親に懲役１３年＝「虐待主導、身勝手極まりない」－５歳女児死亡・東京地裁

　東京都目黒区で２０１８年、船戸結愛ちゃん＝当時（５）＝が虐待死した事件で、傷害と保護責任者遺棄致死などの罪に問われた父親の雄大被告（３４）の裁判員裁判の判決が１５日、東京地裁であった。守下実裁判長は「苛烈な虐待を主導し、身勝手極まりない」と指弾し、懲役１３年（求刑懲役１８年）を言い渡した。
　守下裁判長は、結愛ちゃんは母親優里被告（２７）＝懲役８年、控訴＝の連れ子で、香川県から目黒区に転居した１８年１月２３日ごろから、雄大被告に食事制限をされ、「１カ月余りで体重の約２５％が失われ、異常な痩せ方をした」と述べた。雄大被告については、２月２４～２６日ごろ、結愛ちゃんを風呂場で手加減なく多数回殴り、「２７日には嘔吐（おうと）を把握し、生命の危険を認識した」と判断。弁護側の「死亡前日の３月１日に認識した」との主張を退けた。
　さらに「虐待発覚を恐れる保身から、医療措置を受けさせなかった」と非難。弁護側は類似事件の量刑傾向から、懲役９年が相当と訴えていたが、判決は「しつけからかけ離れ、言い付けを守らないなどと、感情任せに虐待した。児童虐待には従前に増して厳しい非難が妥当。先例に変容を与える」と結論付けた。
　判決によると、雄大被告は１８年１月下旬から結愛ちゃんを栄養失調に陥らせ、２月下旬には風呂場で冷水を浴びせ顔を殴打。優里被告と共謀して医療措置を受けさせず、３月２日、肺炎を発症させるなどして死亡させた。両被告は事件後に離婚した。
　判決後に記者会見した裁判員の女性は「（自分も）母で、心が痛み動揺した」と公判を振り返り、類似事件の傾向を踏まえて量刑判断することに「葛藤があった」と明かした。（2019/10/15-18:18）

Tokyo District Court sentenced the stepfather of a girl to 13 years in prison on Tuesday over a high-profile abuse case in which the five-year-old daughter died in Tokyo's Meguro Ward in 2018.
   Public prosecutors sought an 18-year prison term for Yudai Funato, 34, who was indicted on charges including of causing bodily injuries to the girl and negligence as a guardian resulting in her death.
   According to the indictment, Funato caused his daughter, Yua, to suffer malnutrition from late January 2018 and sprayed cold water on her while hitting her in the face in the bathroom of their home a month later.
   On March 2 that year, Yua is believed to have died of pneumonia after her parents did not allow her to receive medical treatment.
   Funato's wife, Yuri, 27, was sentenced to eight years in prison last month for failing to protect her daughter.
